Aqua Connect Files Patent Infringement Complaints Against Apple in The International Trade Commission and in Federal Court

ORANGE, California - October 11, 2017 - Aqua Connect, Inc. announced today that it filed complaints in the United States International Trade Commission and the District Court for the Central District of California alleging that Apple’s Mac computers, iPhones, iPads, iPods, and Apple TVs infringe its two United States patents.

The patents are U.S. Patent RE46,386, titled “Updating a User Session in a Mach-derived Computer System Environment” and U.S. Patent 8,924,502, titled “System, Method and Computer Program Product for Updating a User Session in a Mach-derived System Environment.”  Both patents relate to screen sharing, remote desktop, and terminal server technology.

“Aqua Connect invented and built the first fully functional remote desktop and terminal server solution for Mac in 2008,” said Ronnie Exley, CEO of Aqua Connect.  “Initially, our product had Apple’s full support.  But years later, Apple built our technology into its macOS and iOS operating systems without our permission.  These lawsuits seek to stop Apple from continuing to use our technology in their macOS and iOS operating systems.”

Apple manufactures Macs, iPhones, iPads, iPods, and Apple TVs in China and imports them into the United States.  Aqua Connect’s ITC complaint seeks an exclusion order and a cease and desist order barring Apple from importing its infringing products into the United States.  If the lawsuit is successful, Apple would no longer be allowed to import these products.

Aqua Connect’s district court complaint alleges that Apple’s infringement has been willful and seeks damages for Apple’s past infringement.  It also seeks to enjoin Apple from continuing to infringe Aqua Connect’s patents.

Aqua Connect is represented by Gregory Dovel, Rick Lyon, and Simon Franzini of Dovel & Luner, LLP.
